If you received an automated call on your mobile telephone from Cenlar FSB (“Cenlar” or “Defendant”) between December 18, 2016, and December 18, 2021, after revoking your consent to be contacted this way, this class action settlement may affect your rights.

Further, if you are a California resident who requested in writing that Cenlar stop contacting you and thereafter you received a letter asking you to sign and return a form or received at least one subsequent telephone call from Cenlar, between December 18, 2019, and December 18, 2021, this class action settlement may affect your rights.

  • A class action lawsuit captioned Shayan Kamrava v. Cenlar Capital Corporation D/B/A Central Loan Administration and Reporting A/K/A Cenlar FSB, Case No. 2:20-CV-11465 (the “Lawsuit”), was filed in the United States District Court for the Central District of California on December 18, 2020, and alleges that Cenlar FSB violated the Telephone Consumer Protection Act, 47 U.S.C. § 227, et seq. (“TCPA”) and, in California, the Rosenthal Fair Debt Collection Practices Act, Cal. Civ. Code § 1788, et seq. (“RFDCPA”).

  • Cenlar FSB denies any wrongdoing and denies the claims and allegations asserted in the Lawsuit. The Court has not ruled on the merits of the plaintiff Shayan Kamrava’s (“Plaintiff”) claims and has made no determination of violations or liability against Cenlar FSB. The parties nevertheless have agreed to settle the Lawsuit (“Settlement”) to avoid the expense and risk of continued litigation.

  • You may receive a payment as part of this Settlement if you: (1) received an automated call on your mobile telephone from Cenlar FSB between December 18, 2016, and December 18, 2021, after revoking your consent to be contacted this way; and/or (2) requested in writing that Cenlar FSB stop contacting you and thereafter received a letter asking you to sign and return a form or received at least one subsequent telephone call from Cenlar FSB, between December 18, 2019, and December 18, 2021.

  • Your legal rights are affected by whether you act or don’t act. Read the Notice carefully.


YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT
DO NOTHING

Receive a payment. If you received an automated call on your mobile telephone from Cenlar between December 18, 2016, and December 18, 2021, after revoking your consent to be contacted this way, you may receive an award payment if and when this Settlement is approved by the Court.

California residents who requested in writing that Cenlar stop contacting them, and still received a letter or telephone call from Cenlar between December 18, 2019, and December 18, 2021 may receive an additional award payment.

EXCLUDE YOURSELF

Do NOT receive a payment. This is the only option that allows you to ever be part of any other lawsuit against Cenlar about the legal claims in this case.

OBJECT

Write to the Court about why you don’t like the Settlement.

GO TO A HEARING

Ask to speak in Court about the fairness of the Settlement.


The Court in charge of this case must still decide whether to grant final approval of the Settlement. Settlement Award payments will be made if the Court grants final approval and after appeals, if any, are resolved. Please be patient.
